These Terms and Conditions (“Terms”) govern the use of the services (“the Services”) provided by tomooyamaji.com (“the Company”, “we”, “our”, or “us”) on this website.
All registered users (“Users”) agree to be bound by these Terms when using the Services.

2.2 The Company may refuse registration if any of the following apply, and is under no obligation to disclose the reason:

  • The Company determines that registration is inappropriate for any other reason
3. Management of User ID and Password

3.1 Users are responsible for securely managing their User ID and password.
3.2 Users must not transfer, lend, or share their User ID or password with any third party.
If a login is made using a matching User ID and password, the Company will consider it to be the User’s own action.
3.3 The Company is not liable for any damages resulting from unauthorized use of a User ID or password unless caused by the Company’s intentional misconduct or gross negligence.

4. Fees and Payment

4.1 Users shall pay the fees displayed on the website for paid portions of the Services using the payment methods designated by the Company.
4.2 If a User delays payment, a late fee of 14.6% per annum will be charged.

5. Prohibited Conduct

Users must not engage in any of the following:

  • Violating laws or public order
  • Engaging in criminal activity
  • Infringing intellectual property rights related to the Services
  • Damaging or interfering with servers or networks of the Company or third parties
  • Using information obtained through the Services for commercial purposes
  • Interfering with the operation of the Services
  • Attempting unauthorized access
  • Collecting or storing personal information of other users
  • Using the Services for fraudulent purposes
  • Causing disadvantage, damage, or discomfort to other users or third parties
  • Impersonating another user
  • Advertising, soliciting, or conducting business activities without permission
  • Using the Services for the purpose of meeting strangers
  • Providing benefits to antisocial forces
  • Any other conduct deemed inappropriate by the Company
6. Suspension of the Services

6.1 The Company may suspend or interrupt all or part of the Services without prior notice if:
System maintenance or updates are required
The Services cannot be provided due to force majeure (earthquake, lightning, fire, power outage, natural disaster, etc.)
Systems or communication lines fail due to an accident
The Company determines that providing the Services is difficult

6.2 The Company is not liable for any damages incurred by Users or third parties due to suspension or interruption of the Services.

7. Usage Restrictions and Account Termination

7.1 The Company may restrict a User’s access to the Services or terminate their account without prior notice if:

  • The User violates any provision of these Terms
  • False information is found in the registration details
  • Payment obligations are not fulfilled
  • The User does not respond to Company communications for an extended period
  • The User has not used the Services for a certain period
  • The Company determines that continued use is inappropriate

7.2 The Company is not liable for any damages resulting from actions taken under this Article.

8. Withdrawal

Users may withdraw from the Services by following the withdrawal procedures specified by the Company.

9. Disclaimer and Limitation of Liability

9.1 The Company provides the Services “as is” and makes no warranties, express or implied, regarding safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or non?infringement.
9.2 The Company is not liable for any damages arising from the use of the Services unless caused by intentional misconduct or gross negligence.
If the contract between the Company and the User constitutes a consumer contract under applicable law, this limitation may not apply.
9.3 Even in cases where liability cannot be fully disclaimed, the Company is not liable for damages arising from special circumstances, whether foreseeable or not.
Compensation for damages caused by the Company’s negligence (excluding gross negligence) is limited to the amount of fees received from the User in the month the damage occurred.
9.4 The Company is not responsible for disputes, transactions, or communications between Users or between Users and third parties.

10. Changes to the Services

The Company may modify, add, or discontinue the Services with prior notice to Users. Users agree to such changes.

11. Changes to the Terms

11.1 The Company may revise these Terms without obtaining individual consent if:

  • The revision benefits Users

Unless Users submit a change request, the Company will treat the registered contact information as valid, and communications sent to that address are deemed delivered at the time of dispatch.

14. Prohibition of Assignment

Users may not assign or transfer their contractual position or rights and obligations under these Terms to any third party without prior written consent from the Company.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan.
Any disputes arising from the Services shall be subject to the exclusive jurisdiction of the court having authority over the Company’s principal place of business.
